Terms of Service

Brainforest provides strategy, brand, marketing and AI adoption consulting, including:

• AI Readiness Index at readiness.brainforest.com: AI Snapshot, Executive Diagnostic and 90-Day Advisory.
• Brainforest AEO: answer engine optimization analysis and recommendations.
• Consulting engagements described in a proposal or statement of work.

Where a signed proposal or statement of work conflicts with these terms, the signed document controls.

Prices are shown at checkout or in your proposal, in US dollars. Payments are processed by Stripe and are subject to Stripe's terms. You authorize us to charge the payment method you provide. Fees are due when ordered unless your proposal says otherwise, and you are responsible for any applicable taxes.

For the AI Snapshot and the Executive Diagnostic, if we cannot find at least 10 times the fee you paid in sourced, defensible opportunity, we will refund the full fee. Request a refund by emailing hello@brainforest.com within 30 days of receiving your deliverable. The guarantee applies to those two services only.

Fees paid for the AI Snapshot or Executive Diagnostic can be credited toward your next step with Brainforest if you purchase it within 90 days of the original purchase. Credits have no cash value, are not transferable and expire after 90 days. A refunded fee cannot also be used as a credit.

Reports, diagnostics, recommendations and other deliverables are for informational purposes. They are not legal, tax, accounting or financial advice. Consult qualified professionals before making decisions in those areas. Opportunity estimates are estimates, not guarantees of results.

Parts of our deliverables are produced with the help of AI tools and reviewed by our team. AI output can contain errors or omissions. You are responsible for reviewing deliverables and deciding how to use them.

You agree to provide accurate, complete and current information, and to have the right to share any information you give us. Our findings depend on your inputs; we are not responsible for conclusions based on inaccurate or incomplete information.

We treat the non-public business information you share as confidential and use it only to deliver the Services, sharing it only with the service providers and delivery partner described in our Privacy Policy. This does not apply to information that is public, already known to us, or that we must disclose by law.

Once paid in full, you may use your deliverables for your internal business purposes. Brainforest keeps ownership of its methods, frameworks, templates, software and website content. You keep ownership of the information you provide to us.

To the fullest extent permitted by law, Brainforest is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Services is limited to the fees you paid for the service giving rise to the claim in the 12 months before it arose. The Services are provided "as is" without warranties except as stated in these terms.

These terms are governed by the laws of the State of Arizona, USA, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona.

We may update these terms. The "Last updated" date above shows when they last changed. Continued use of the Services after a change means you accept the updated terms.
